The Election Commission continues with brutal violation of the law

VeselinRadulovicADVThe Election Commission of the Capital City Podgorica continues with a brutal violation of the law and at the second meeting that was suppose to consider complaints about violations of voting rights in the elections that were held on Sunday. After they, on the first session, with two decisions refused about thousand and five hundred complaints, the Election Commission on the meeting last night that lasted 45 minutes refused additional 900 complaints in the similar way.

In contrast to the decision from the first meeting when firstly were rejected complaints “submitted until 6pm”, and then complaints “submitted after 10pm”, the Election Commission now changed its way of work. So on the meeting held last night they made a decision to “reject all complaints submitted by Miodrag Lekic”and a decision to “reject all complaints submitted for certain polling stations”.

Thus, the Electoral Commission tried to correct legal nonsense from the first meeting when they rejected complaints in group depending on time when they were submitted, but now they adopted new decisions, also unrecorded in legal practice when an authority decides on any legal means. By rejecting complaints because they were submitted by a certain person or because they relate to certain polling stations, confirms that the Election Commission knowingly makes political and completely illegal decisions.

Again, the majority of the Election Commission of the Capital City demonstrated the power and deliberately stepped on the Constitution of Montenegro. Even more, this way of work and these decisions of the Commission degrade the Constitution and the legal system of this country, but also and common sense of all citizens, because only someone retarded may believe that about 900 complaints legal decision could be brought in 45 minutes.

Last night’s session additionally confirmed that the statements by the President of the Commission are untrue that all complaints are reviewed individually and were rejected unanimously. To everyone who has a minimum mind and who ever read anything is clear that on the session that lasted 45 minutes, the Commission could not read over 900 complaints and additional 900 records from the polling stations on which records were related. Also, the complaints were not rejected individually as yesterday Raicevic claimed, but mostly by those who were confirmed on the previous session by Raicevic that on election day keep records on voters who vote.

Because of that and about these decision of the Election Commission of the Capital City of Podgorica the State Election Commission will have to make own statement, from which we expect to be at least little more serious about its work and to consider complaints additionally and in details about time when they were submitted and who submitted them. The State Election Commission is obligated to fully and properly determine facts of the case, or to determine whether a violations of voting rights have occurred, which was pointed on with each complaint.

Also, the State Election Commission will have to conclude whether is it possible to decide about 900 complaints in 45 minutes, actually whether is it possible to resolve more than 20 complaints in one minute, or one compliant in less than three seconds, as average time they had. The State Election Commission will have to determine how is possible to read one complaint in less than three seconds, the record from the place to which it relates, and than all of that consider and make a decision, given that the President of the Election Commission of the Capital City claims that each complaint considered individually.

MANS will monitor the work of the State Election Commission when it decides on the complaints to the decisions of the Election Commission of the Capital City, and it is ready to provide to the State Election Commission all needed help in order to properly establish the facts on the polling stations where our observers were exposed to pressure, harassment, and even physically attacked by those who in less than three seconds voted for the decision that everything was legal.
