Criminal complaint against Milo and Ana Đukanović and several officials

Today, the Network for Affirmation of NGO Sector (MANS) filed a criminal complaint against Montenegrin President Milo Đukanović and his sister, lawyer Ana Đukanović, as well as against several persons involved in the privatization of Montenegrin Telekom Crna Gora in 2005 due to suspicion of abuse of office and passive bribery.

The criminal complaint is submitted to the Special Prosecutor for suppressing organized crime and corruption, and in addition to Milo and Ana Đukanović, NN persons are also included – government officials from 2005, in the period of privatization of Telekom, as well as NN persons who participated in concluding of fictitious contracts with the companies Fiesta, Aktiva, Sigma and Roli through which bribes were paid.

In addition, Veselin Barović, Oleg Obradović, Damjan Hosta and Tamás Morvai, a representative of Magyar Telekom, are also included in the criminal complaint.

The aforementioned persons are charged that, through organizing of a criminal group, using the economic and business structures of Montenegro, by influencing the executive power, ensured for the Government of Montenegro to enable Magyar Telekom to buy shares of minority shareholders under more favorable terms and thus obtain two thirds of shares of Telekom Crna Gora, which was a condition for the purchase of the state package of the company shares.

“They then made fake – simulated contracts through which the bribe to the reported person Milo Đukanović and other still unidentified persons was paid in the amount of €7.4 million, which they acquired, kept and used knowing that, at the moment of receiving, money came from a criminal offense, while at the same time falsely presenting facts about the nature of that money that was paid as a bribe and falsely presenting that it is money paid for services rendered, ” it is stated in the complaint.

We remind that the condition for the purchase of Telekom Crna Gora by Magyar Telekom was to enable them to purchase two-thirds of shares, which was contrary to the conditions prescribed by the tender.

In its report, the tender commission noted that Magyar Telekom in its offer referred to an additional offer that “intends to offer €51 million i.e. €2.2 per share to minority shareholders for the purchase of their shares.”

“Due to all of the above, the Tender Commission commented in the Report that these are material changes of such nature that, besides the sellers and the subject of the purchase, they represent a completely new contractual relationship, in which the position of the seller, due to its increased responsibility on one hand and the powers of the buyer on the other hand, is very unfavorable,” it is stated in the complaint.

The complaint also states that in order to meet conditions set by Magyar Telekom, a secret meeting was held in Podgorica, attended by Oleg Obradović, Veselin Barović as the representative of Eurofond, Damjan Hosta registered as representative of Monte Adria, Tamás Morvai as representative of Magyar Telekom and Johannes Solih and Silvija Radišić as consultants of Magyar Telekom during the acquisition of Telekom Crna Gora. After the meeting, Obradović agreed with Đukanović and other NN persons from the Government for the Government to pay to minority shareholders of Telekom Crna Gora €0.3 per share.

On the same day, January 12, 2005, Obradović held another meeting, with the director of a consulting firm that advised Magyar Telekom in the privatization of Telekom Crna Gora, where it was confirmed that the Government should pay €0.3 per share to minority shareholders.

“All of the above stems from the evidence presented at the hearing of Director of Magyar Telekom in the United States, during a trial against three directors led by the Federal Court in Manhattan,” it is stated in the complaint.

After that, in order to pay off the bribe to those who ensured that Magyar Telekom took over two thirds of shares of Telekom Crna Gora under favorable terms, Magyar Telekom concluded two simulated contracts with Fiesta and Aktiva, while Telekom Crna Gora and related companies concluded two simulated contracts with companies Sigma and Roli. The subject of all four contracts was performing of alleged consulting services.

Part of the bribe in the amount of €580 was paid through the reported person Ana Đukanović (then Kolarević).

Magyar Telekom confessed and accepted responsibility before the authorities of the United States for actions of its officials, including responsibility for signing a contract with Sigma.

“This contract was signed on behalf of Hungar Telekom by Tamás Morvai, who did not specify the correct date when it was made, in order to enable the payment of the amount of €580 thousand to the reported person Ana Đukanović, for the services she did not provide and which, under much lower prices, were provided by internal and regular external advisers of Magyar Telekom, ” it is stated in the complaint.

During previous explaining of the dismissal of Telekom case, the Special State Prosecutor completely ignored the findings of the U.S. institutions and the statements of the representatives of Magyar Telekom, and excluded from the complete investigation the suspicions concerning Đukanović family and persons related to them.
