MPs TO PROTECT CITIZENS FROM UNLAWFUL WORK OF THE STATE ADMINISTRATION

With the proposed amendments to the Law on Administrative Disputes, the costs of the unlawful and untimely work of the state administration are transferred to the citizens.

That is why we call on the MPs to submit amendments to the proposed changes in the Law which is on the agenda of the Parliament session, and protect citizens from arbitrariness and unlawful work of the state administration.

These amendments to the Law stimulate the untimeliness of the state administration which violates the rights of citizens, because for years, it does not meet the deadlines for decision-making, and the costs of such actions are transferred to citizens whose rights have already been violated.

The proposed amendments basically suspend all deadlines in administrative procedures, as the authorities are enabled to act with months-long delay without any consequences, at the expense of the citizens.

The proposed amendments introduce a too broad discretionary right of the court, which will fundamentally lead to the abolition of the right to an oral argument, but also to the abolition of all deadlines for decision-making by the Administrative Court.

The proposed amendments introduce the discretionary right of the court to join proceedings and transfer the burden of the state administration errors to citizens who must file separate lawsuits against each individual administrative act, and therefore bear the costs of lawyers.

The joining of several lawsuits in an administrative dispute is not recognized by any of the laws from the region, and especially not for the purpose of a decision on the costs of the proceedings.

Such amendments to the law were also previously proposed by some MPs from DPS and SDP, but they were abandoned due to criticism from the NGO sector and the then opposition.

That is why we expect the current parliamentary majority to amend the proposed changes in the Law and protect the rights of citizens. MANS has sent draft amendments to all parliamentary groups that can improve the proposed changes in the Law.
