Reacting to the judgement in the “Krimovica” case
Two years after the proceedings, the Basic Court in Kotor issued a judgement in the “Krimovica” case, which unequivocally indicates the extent to which Montenegrin judiciary is still trapped and how, despite numerous evidence, it is still difficult to achieve justice in Montenegro.
The fact that the former head of the Municipality of Budva was acquitted shows that the Basic Court in Kotor completely ignored the fact that Marko Carević was the head of the company “Carinvest” until 2021, and that the usurpation and illegal construction began in 2015, and it was precisely Carević Sr. who played a decisive role in committing of that criminal act.
According to what is currently known to the public, the basic court of Kotor convicted only Milan Carević for usurpation, who appears as the formal owner of the company as of 2021. Such neglect of commonly known and easily verifiable facts points to the suspicion that the judgement, which is not legally binding for the time being, was not passed as a result of ignorance, but rather as an attempt to protect individual interests.
Also, the sentenced amount of 100,000 euros is shameful and represents only part of the damage that the state of Montenegro suffered during the years-long usurpation of close to half a million square meters in Krimovica.
MANS calls on the acting prosecutor in this case to file an appeal without delay against this judgement of the Basic Court of Kotor, both when it comes to the acquittal of the Carević Sr., as well as the amount of the sentence, and the fact that during the entire duration of the court proceedings, he used without hindrance the property which he was accused of usurping.
Now that the usurpation has been proven before the competent court, we expect that the state authorities will also take all necessary measures for the half a million of square meters in Krimovica to be returned to the state ownership.
