The adoption of this document effectively legalized the buildings that were illegally erected on a parcel belonging to Nik\u0161i\u0107-based businessman Branislav Mi\u0107unovi\u0107.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">In spite of the fact that the parcel already houses several illegal buildings, and that the recently adopted document violates the provisions of Budva&#8217;s Spatial Plan, the Ministry of Sustainable Development has given its support to this solution (effectively enabling the retroactive legalization of the illegal buildings at Miri\u0161te).<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">In the initiative launched today before the Constitutional Court, we contest the urban planning solutions found in the Location Study for contravening existing regulations of a higher-order.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">This includes the Spatial Plan of Budva, which designates the Miri\u0161te location as allotted for: &#8220;tourist accommodations of smaller size to be integrated with the surrounding green-space.&#8221;<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">In spite of this, the recently adopted urban plan adopted by the municipal council permits the building of one large building and one smaller building. The existing buildings on the parcel in question can in no way be said to fulfill the limitations imposed by the Spatial Plan of Budva (which after all is a document of higher-order that should take precedence).<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">In our initiative before the Constitutional Court, we noted that the existing solution also violates the 2005 Rule Book on Classifications, which outlines the minimal conditions and categorization of hospitality buildings.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">According to this document, developers are required to secure an additional 60-100m2 of free and green spaces per hotel guest, depending on the hotel&#8217;s rating. A simple calculation reveals that Mi\u010dunovi\u0107&#8217;s parcel cannot contain the projected amount of beds if all the regulations were followed. At most, accommodations for 20 beds could be secured legally. Instead of approving such a scale of development, the Ministry gave the green light to erecting a building that is four times the allotted size &#8211; standing at around 5,000 m2 of floor space &#8211; thus legalizing the construction already found on this parcel.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">The intensity with which the Ministry is protecting this planning document is shocking. Thus, in spite of the clear violations of the law with respect to the Miri\u0161te parcel, it appears that the Ministry is more concerned with protecting the interests of privileged investors at any cost. Since the &#8216;Zavala&#8217; case we have not seen such high-profile interventions by serving cabinet members at both the state and local level in order to justify and legalize illegally erected buildings.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">More concerning is the fact that currently serving Minister of Sustainable Development, Predrag Sekuli\u0107, is clearly unwilling to break with the corrupt practices of his predecessor. It is for these reasons that the Ministry has gained a reputation for placing itself at the logistical beck and call of domestic and foreign tycoons, whose projects always end-up receiving a green-light from the Ministry.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">This practice has prevented the Ministry from becoming an ally to state bodies that are charged with carrying out the struggle against corruption and organized crime in the urban planning sector. On the contrary, the Ministry has become the main institution for legitimating illegal construction through retroactive measures.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">As a result of the &#8220;Miri\u0161te&#8221; case, MANS has initiated legal proceedings against the current and former ministers of urban planning for abusing their position and allowing a privileged investor to get away with breaking the law.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">2011\/9\/13 Dejan Milovac &lt;dejan.milovac@mans.co.me&gt;<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Podgorica, 13. septembar 2011. godine<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">SAOP\u0160TENJE ZA MEDIJE<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">MANS je danas Ustavnom sudu Crne Gore podnio inicijativu za pokretanje postupka ocjene zakonitosti Lokalne studije lokacije \u201eMiri\u0161te\u201c koju je Skup\u0161tina Op\u0161tine Budva usvojila po\u010detkom septembra i time legalizovala nelegalno izgra\u0111ene zgrade na parceli nik\u0161i\u0107kog biznismena, Branislava Mi\u0107unovi\u0107a.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Uprkos \u010dinjenici da se na parceli za koju se izra\u0111uje plan ve\u0107 nalazi nekoliko nelegalno izgra\u0111enih zgrada, kao i tome da predlog plana nije u skladu sa Prostornim planom op\u0161tine Budva, Ministarstvo odr\u017eivog razvoja je dalo saglasnost na taj dokument, \u010dime je omogu\u0107eba legalizacija.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">U inicijativi koja je danas dostavljena Ustavnom sudu, osporili smo urbanisti\u010dka rje\u0161enja iz studije lokacije jer su u suprotnosti, kako sa programskim zadatkom koji predstavlja osnovu za izradu plana, tako i sa planom vi\u0161eg reda.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Naime,  Prostorni plan op\u0161tine  Budva za lokaciju Miri\u0161te propisuje da je lokacija \u201cpredvi\u0111ena za turisti\u010dku izgradnju manjih objekata uklopljenih u zelenilo\u201d.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Nasuprot tome, kona\u010dna urbanisti\u010dka rje\u0161enja koja su usvojena u lokalnom parlamentu podrazumijevaju jedan ve\u0107i glavni objekat i jedan manji, pomo\u0107ni, koji prema onome \u0161to ve\u0107 postoji na terenu, nikako ne mogu zadovoljavati smjernice iz Prostornog plana op\u0161tine Budva kao plana vi\u0161eg reda.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">U inicijativi smo naglasili da ovakvo rje\u0161enje nije u skladu ni sa Pravilnikom o klasifikaciji, minimalnim uslovima i kategorizaciji ugostiteljskih objekata iz 2005. godine na koji se Op\u0161tina Budva poziva u Programskom zadatku za izradu lokalne studije lokacije \u201eMiri\u0161te\u201c i napominje da budu\u0107e urbanisti\u010dko rje\u0161enje mora biti u skladu sa njime.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Naime, prema pravilniku je na lokaciji potrebno obezbijediti i dodatnih 60-100m2 slobodnih i zelenih povr\u0161ina po gostu hotela, u zavisnosti od kategorije hotela. Prostom ra\u010dunicom, jasno je da na parceli Mi\u0107unovi\u0107a u najboljem slu\u010daju bilo mogu\u0107e projektovati hotel sa tri zvjezdice, povr\u0161ine 1.200 m2 bruto gra\u0111evinske povr\u0161ine sa oko 20 le\u017eajeva. Umjesto toga, Ministarstvo je dalo saglasnost na \u010detiri puta ve\u0107i objekat \u2013 oko 5000 m2, koji je ve\u0107 i bio nelegalno sagra\u0111en na parceli Mi\u0107unovi\u0107a.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Sa time u vezi, zapanjuju\u0107a je upornost kojom Ministartvo brani ovaj planski dokument, i da bez obzira \u0161to je zakon o\u010digledno prekr\u0161en, poku\u0161ava da na\u0111e opravdanje za o\u010diglednu namjeru da se po svaku cijenu za\u0161tite interesi privilegovanog investitora. Jo\u0161 od slu\u010daja \u201eZavala\u201c nismo imali zabilje\u017een toliki anga\u017eman visokih javnih funkcionera na dr\u017eavnom i lokalnom nivou da se jedan pojedina\u010dan slu\u010daj nelegalne gradnje poku\u0161a opravdati i legalizovati.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Mnogo vi\u0161e od samog slu\u010daja Miri\u0161te zabrinjava \u010dinjenica \u0161to ministar Predrag Sekuli\u0107 o\u010digledno ne \u017eeli da vr\u0161i kontrolnu funkciju u procesu planiranja i ure\u0111enja prostora, \u0161to na\u017ealost predstavlja samo nastavak prakse koju je uspostavio njegov prethodnik, Branimir Gvozdenovi\u0107. Zbog toga je ovo ministarstvo vremenom uspjelo sebe da promovi\u0161e u logisiti\u010dki servis stranim i doma\u0107im tajkunima \u010diji projekti uvijek imaju zeleno svjetlo u ministarstvu, pa \u010dak i po cijenu kr\u0161enja zakona.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Takva praksa je ne samo potpuno onemogu\u0107ila ovo ministarstvo da bude saveznik dr\u017eavnim organima u borbi protiv korupcije i organizovanog kriminala u urbanizmu,  ve\u0107 ga definisala kao glavnu instituciju za prikrivanje tragova kr\u0161enja zakona u ovoj oblasti kroz davanje saglasnosti na planove i legalizaciju objekata.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">MANS je zbog slu\u010daja \u201eMiri\u0161te\u201c protiv biv\u0161eg i aktuelnog ministra urbanizma ve\u0107 podnio krivi\u010dnu prijavu zbog sumnje da su zloupotrijebili slu\u017ebeni polo\u017eaj sa ciljem da privilegovanom investitoru na Miri\u0161tu omogu\u0107e da prvo nelegalno sagradi dvije zgrade, a zatim ih kroz dono\u0161enje planske dokumentacije i legalizuje.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Dejan Milovac<br \/>\nDirektor programa za urbanizam<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n","protected":false},"excerpt":{"rendered":"<p>(Podgorica, 13 Septembar 2011) &#8211; MANS today submitted an initiative to the Constitutional Court of Montenegro to begin proceedings concerning the legality of the &#8220;Miri\u0161te&#8221; Location Study, which the Budva Municipal Council adopted in early September.
