\"RadojeExplanation of the Minister of Finance, Radoje Zugic<\/strong>, that the newest Government’s Decree\u00a0on compensation for fuel has a foundation in the Law on Energy and\u00a0Fiscal policy is just a continuation of manipulation that attempt to\u00a0fully justify the illegal and unconstitutional introduction of \u00a0another levy imposed \u00a0on citizens to finance the Government’s harmful decisions.<\/p>\n

The the Law on Energy, referred to by the Minister Zugic in article\u00a0173 is\u00a0stated that the Government defines only way “of forming the maximum\u00a0retail price of certain petroleum products and\/or biofuel”\u00a0as well as “the manner and terms of publication of those prices”, \u00a0but \u00a0no Article of this Law allows\u00a0the Government the authority to, beside the Parliament of\u00a0Montenegro, adopts decisions that impose on citizens new taxes and\u00a0fees such as this on fuel.<\/p>\n

In addition, even if in the Law on Energy stipulates that the Government of Montenegro can\u00a0independently, beside the Parliament, adopt decisions on taxes and\u00a0other charges, the Law on Energy would be at odds with the Constitution of Montenegro, which clearly defines that this kinds of regulations can be\u00a0prescribe only by the law adopted in the Parliament of Montenegro.<\/p>\n

When it comes to the state fiscal policy reffered on by the Minister Zugic, it must be fully compliant and based with\u00a0Montenegrin laws and the Constitution which clearly defines that decisions on\u00a0prescribing taxes and other charges are made in the form of laws and are adopted in the\u00a0Parliament of Montenegro.<\/p>\n

In this respect, the explanation of the Minister Zugic is completely unfounded and\u00a0can not represent an excuse for breaking the law and the Constitution of Montenegro,<\/p>\n

which will hopefully be recognized and by \u00a0the Constitutional Court when deciding on\u00a0initiative of MANS.<\/p>\n

MANS today\u00a0\u00a0officially submitted to the\u00a0Constitutional Court of Montenegro the initiative by\u00a0which we warned that institution on violation of the Constitution of\u00a0Montenegro and the fact that the Government exceeded its constitutionally defined\u00a0authority when independently and arbitrarily made a decision on imposition of a new\u00a0taxes \u00a0in Montenegro.<\/p>\n

MANS requested from the Constitutional Court to declare\u00a0unconstitutional\u00a0the controversial Government’s Decree\u00a0and put it out of force, and that by the time of making such a decision issues a\u00a0command on the suspension of the execution of individual acts arising from\u00a0such provisions, actually to prevent an increase the price of fuel for seven\u00a0cents per liter.<\/p>\n

We invite the Constitutional Court to urgently reconsider our initiative to\u00a0prevent further impact on the budgets of the citizens of Montenegro and spiral\u00a0increase in prices of goods and services whose formation depends on the price\u00a0fuel.<\/p>\n
