Access Info today voiced its serious concern and urged the Government to reconsider.<\/span><\/p>\n<p><a href=\"https:\/\/mans.co.me\/en\/wp-content\/uploads\/2019\/09\/Slobodan-pristup-informacijama.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-7722\" src=\"https:\/\/mans.co.me\/en\/wp-content\/uploads\/2019\/09\/Slobodan-pristup-informacijama.jpeg\" alt=\"\" width=\"1298\" height=\"457\" srcset=\"https:\/\/mans.co.me\/en\/wp-content\/uploads\/2019\/09\/Slobodan-pristup-informacijama.jpeg 1298w, https:\/\/mans.co.me\/en\/wp-content\/uploads\/2019\/09\/Slobodan-pristup-informacijama-300x106.jpeg 300w, https:\/\/mans.co.me\/en\/wp-content\/uploads\/2019\/09\/Slobodan-pristup-informacijama-768x270.jpeg 768w, https:\/\/mans.co.me\/en\/wp-content\/uploads\/2019\/09\/Slobodan-pristup-informacijama-1024x361.jpeg 1024w\" sizes=\"auto, (max-width: 1298px) 100vw, 1298px\" \/><\/a><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, sans-serif;\">Together with\u00a0MANS, an anti-corruption NGO in Montenegro, Access Info has submitted a\u00a0<a href=\"https:\/\/www.access-info.org\/wp-content\/uploads\/2019-10-15-Montenegro-Amendments-Submission.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.access-info.org\/wp-content\/uploads\/2019-10-15-Montenegro-Amendments-Submission.pdf&amp;source=gmail&amp;ust=1573040199442000&amp;usg=AFQjCNGA1RIg1TFaJeiTeJHI-M77y0xHvw\">legal analysis<\/a>\u00a0of the proposed amendments to Montenegro\u2019s Ministry of Public Administration on Law on Free Access to Information.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, sans-serif;\">The proposed changes would take Montenegro further away from international standards on transparency. Specifically, they would result in a law that is in direct breach of Montenegro\u2019s international commitments, including its ratification of the Council of Europe Convention on Access to Official Documents, and its obligation to protect freedom of expression and information under the European Convention on Human Rights and the International Covenant on Civil and Political Rights.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, sans-serif;\">Even where the changes are not regressive, they fail to significantly improve the law to bring it into line with international standards.\u00a0These are not the advances on transparency that Montenegro has pledged to make as a member of the\u00a0<a href=\"https:\/\/www.opengovpartnership.org\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.opengovpartnership.org\/&amp;source=gmail&amp;ust=1573040199442000&amp;usg=AFQjCNGusS2IYrjaeSJLrlZ_el8kRHASkA\">Open Government Partnership<\/a>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, sans-serif;\">The proposed changes suggested by the Montenegrin government would:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: arial, sans-serif;\">add broad blanket exclusions on the right of freedom of information;<\/span><\/li>\n<li><span style=\"font-family: arial, sans-serif;\">allow authorities the ability to reject what they define as \u201cunreasonable\u201d requests;<\/span><\/li>\n<li><span style=\"font-family: arial, sans-serif;\">narrow the right to cover only information that is of apparent \u201cpublic importance\u201d;<\/span><\/li>\n<li><span style=\"font-family: arial, sans-serif;\">include exceptions that are not permitted under international law;<\/span><\/li>\n<li><span style=\"font-family: arial, sans-serif;\">add exceptions where the harm test will not be applied.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, sans-serif;\"><em>\u201cThe amendments proposed by the Montenegrin government to its Law on Free Access to Information\u00a0undoubtedly violate the fundamental right of freedom of information of the people of Montenegro. These proposals would infringe its commitments to international law, while\u00a0directly contravening the principles of transparency, good governance, and integrity\u201d,\u00a0<\/em>said Helen Darbishire, Executive Director of Access Info.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, sans-serif;\">Access Info strongly urges the Montenegrin government to retract the proposed changes.
