(Podgorica, October 27. 2013.) – In the Basic court in Podgorica, tomorrow at 9am, it will resume hearing of the case based on the Lottery and Jackpot suit against Daily Press and MANS. Early on the NGO MANS submitted to the President of the Basic Court request to expedite the process.
In that regard, we have to emphasize that the facts and evidence suggest that this process lasts unreasonably long basically because of the obstruction and abuse of the process law by the lottery’s lawyer Vladan Bojic, because he knows that his clients claim against MANS is not based on the facts nor on the evidence. In fact, the the first submission from last year, a lawyer Bojic expends lawsuits with allegations that Branislav Micunovic, Sava Grbovic, and their families are affected by MANS to the level that the legal sister can not protect them.
The lawyer Bojic consciously distracted from the dispute, because he knows that the prosecutors are legal people, and he knows that the alleged threat to Micunovic and Grbovic, even if by itself sounds stupid and comic, has nothing to do with the subject in the dispute.
When MANS suggested hearing of this people, based on the circumstances raised by the lawyer Bojic, he continued with further obstruction, stating that the MANS is obsessed with people he “protects” in this case. After the court decided to hear these people, the lawyer Bojic continued to tactically delay the process, by submitting to the court medical records that allegedly confirms that Branislav Micunovic is unable to testify, warning the court of the risks if it is persistent to examine Micunovic.
That was the first case, in history of Montenegrin courts in civil proceedings, and by it additionally the court’s attention was diverted from the case on the health status of Branislav Micunovic, and on the risk that exists from the summons by the court. The Court accepted the medical records of Branislav Micunovic, and the lawyer Bojic in his behalf reports Vanja Calovic for commenting that documentation on the public hearing.
So, by the obstruction and delay by the Lottery’s lawyer, instead on the matters in dispute, the court discusses health of Branislav Micunovic, the alleged violation of his personal rights and the alleged threat to this person and his family by the NGO MANS. Of course, the lawyer Bojic and his clients prefer that the discussion is about Micunovic, rather than about “evidence” that Bojic submitted to the court, in which it is claimed that the in Montenegro the possibility of money laundering is ruled out through lottery games, which is the legal position that never happened in the world.
Beside that, in the current length of the case, the lawyer Bojic three times submitted papers at the hearing or the day before the hearing, which made impossible the defendant to offer own opinion on the same, and by doing that also delayed the process.
During the process, we suggested many times on the Lottery’s obstruction and on distraction on the issues that are not part of this case, but he continued with pointing on health of Branislav Micunovic, the alleged violation of his rights and the “prestige” theta in Montenegro has the person from the Italian indictment list for organized crime.
In addition, the lawyer Bojovic constantly without a valid reason blames MANS for what exactly he does; complains because MANS has the right to seek disqualification of a judge, complains because the president of the court exempted judge who did not give any guarantee to judge impartially, objected when another judge alone seeks exemption because her relatives are friends with Branislav Micunovic and Sava Grbovic, complains when MANS suggests hearing of Micunovic for whom he claims to be threatened and reportedly companied of the length of the proceeding, but he does not submit a request to speed the process, or any action before the court for that purpose.
Therefore MANS requested from the President of the court to order resolution of this case, with hope that the hearing in this case will finally be focused on the relevant facts and that the court will reject the groundless allegations of Branislav Micunovic.
We also expect the court to finally decide whether the NGO MANS has the right to address the issues on business done by the Lottery, that State gave to controversial business people, without public tender, together with the monopoly that will be secured in the future as well, or the fundamental rights and freedom that stop to apply for controversial businessmen and those companies, all represented by the lawyer Bojovic, with excuses they are ill, to experience stress when the court is mentioned, that they are threatened, their privacy is violated, and that they have a high reputation.
We also invite you tomorrow, 10.28.2013, at 9am to follow the trial in which MANS will, once again, prove that all we said about the Lottery and Jackpot is absolute true, and that all comments and ratings are completely justified and based on the facts.
