The Basic Court in Podgorica delevered a judgment that the state is obligated to employees of MANS, who were last year illegally arrested, because of protest in front of the Parliament of Montenegro due to increase of VAT, to pays damages in the amount of 300 euros.
Verdict confirms that the police last year illegally deprived of liberty six employees of MANS, did not inform them of the reasons and basis of the charges against them, nor about the rights they have, so the police officers who performed arrests gave contradictory statements, which indicates that they did not know the reasons and basis for the arrests.
From the evidence the court found that the police during arrests and retention of complainants violated the European Convention for the Protection of Human Rights and Fundamental Freedoms, the Constitution and the laws of Montenegro.
Also, the court said in the judgement that the complainants, as young and educated people, picked a mode of expression and research guaranteed on the basis of rights held by the Constitution of Montenegro and the European Convention for the Protection of Human Rights and Fundamental Freedoms.
So once again it is confirmed that the state to employees in MANS violated the entire corpus of fundamental human rights stipulated by the Constitution and the European Convention, the right to liberty, the right to notice of charge and other rights they have and the rights to counsel.
The encouraging fact is that the Montenegrin courts started to apply the European Convention and standards set forth in the practice of the European Court of Human Rights, but still concerns the fact that the institutions responsible for detection and combating crime repressive apparatus illegally direct toward those who points and reveal corruption and crime.
In the end, we expect that the Higher Court in Podgorica as well applies the European standards and confirms this judgement, especially due to the fact that the legal representative of the state did not during the proceeding, nor in an appeal on the judgement, challenged or objected to any evidence and statement of the claim.
